Acceptance of Terms
By accessing or using B4H (“the Platform”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not access or use the Platform. These Terms apply to all users, including employees, Coaches, and administrators (“Users”).
Definitions
Platform: B4H software and services, including web and mobile applications.
User: Any individual accessing the Platform, including Players and Coaches.
Coach: A User authorized to create, manage, and approve goals within a workspace.
Player: A User who participates in goals to earn rewards.
Workspace: A separate environment within the Platform where goals, Users, and rewards are managed.
Goal: Any task, objective, or activity set on the Platform to be achieved by Players.
Reward: Incentives, financial or otherwise, offered upon completion of a goal.
Evidence: Proof submitted by a Player to validate goal completion.
Eligibility
Users must be at least 18 years old or the minimum legal age in their jurisdiction.
Users must have the legal right to enter into binding agreements.
Companies using the Platform must comply with local labor and employment laws.
Account Registration
Users must register an account with accurate, complete information.
Each User is responsible for maintaining the confidentiality of login credentials.
Users cannot act as a Coach for themselves; conflict-of-interest restrictions apply.
Companies are responsible for assigning roles and permissions in their workspaces.
Workspaces
Workspaces are independent and controlled by Coaches or company administrators.
Users may join multiple workspaces; each workspace’s data and activities remain isolated.
Workspace content, goals, and rewards cannot be transferred between workspaces without explicit permission.
Goals
Goals can be one-time, recurring, or repeatable, with customizable difficulty and category.
Coaches set goals, determine verification methods, and approve goal completion.
Players submit evidence to verify goal completion.
The Platform may offer automated verification where integrations allow.
Expired or inactive goals may be deactivated; Coaches may reactivate goals at their discretion.
Rewards
Rewards are offered per goal completion and may include vouchers, subscriptions, experiences, or other incentives.
Players select rewards upon goal approval; Companies are responsible for funding claimed rewards.
Redemption may require manual approval or be automated depending on company configuration.
B4H is not liable for the delivery of rewards provided by third-party vendors beyond facilitating the process.
Rewards may vary by region and availability; substitutions may be provided if necessary.
User Conduct
Users must not submit false or misleading evidence.
Users must not circumvent system rules or attempt unauthorized access.
Harassment, discrimination, or illegal activity within the Platform is strictly prohibited.
Coaches must act fairly and objectively in goal approval and workspace management.
Data Privacy
B4H collects, stores, and processes personal and performance data in accordance with its Privacy Policy.
Data is used to operate the Platform, generate reports, and provide analytics.
Companies are responsible for ensuring compliance with local data protection laws for their employees.
Users consent to the processing of their data for the purposes of goal verification, analytics, and reward delivery.
Intellectual Property
All content, trademarks, logos, and software within B4H are owned by B4H or its licensors.
Users may not copy, distribute, modify, or create derivative works without express written permission.
User-generated content (e.g., goal submissions, posts, comments) may be used by B4H for internal analytics or promotional purposes with proper anonymization.
Payment and Billing
Companies are billed for redeemed rewards and, optionally, for subscription services providing behavioral analytics.
The pay-for-performance model ensures Companies pay only for claimed rewards.
Quarterly subscriptions are billed in advance and non-refundable unless otherwise agreed.
B4H reserves the right to modify pricing with notice.
Analytics and Reporting
B4H provides insights into engagement, goal performance, reward ROI, and behavioral trends.
Reports are indicative and for internal decision-making; B4H does not guarantee specific business outcomes.
Predictive analytics are based on historical data and subject to model limitations.
Third-Party Integrations
B4H may integrate with HR systems, LMS platforms, wellness apps, and other software.
Users must comply with third-party terms when using integrations.
B4H is not liable for failures or inaccuracies in integrated systems.
Disclaimers
The Platform is provided “as-is” without warranties of any kind, express or implied.
B4H does not guarantee reward availability, goal completion, or financial results.
B4H is not responsible for User negligence, misconduct, or errors.
Limitation of Liability
To the maximum extent permitted by law, B4H is not liable for indirect, incidental, consequential, or punitive damages.
Total liability arising from use of the Platform is limited to fees paid by the Company for the applicable subscription or rewards during the prior 12 months.
Termination
Users may terminate their accounts at any time.
B4H may suspend or terminate accounts for violations of these Terms, illegal activity, or security concerns.
Termination does not release Companies from payment obligations for redeemed rewards or subscriptions.
Governing Law
These Terms are governed by the laws of [Insert Jurisdiction].
Disputes arising from these Terms shall be resolved in the courts of [Insert Jurisdiction].
Amendments
B4H reserves the right to update these Terms.
Updated Terms will be communicated to Companies and Users via the Platform or email.
Continued use of the Platform after changes constitutes acceptance of the updated Terms.
